EMF Direktifi olarak da bilinen 26 Haziran 2013 tarihli ve 2013/35/EU sayılı Avrupa Parlamentosu ve Konseyi Direktifi, çalışanları elektromanyetik radyasyona maruz kalmaktan korumak için asgari sağlık ve güvenlik gereksinimlerini tanımlar.
Yönerge, aşırı elektromanyetik radyasyonun çalışanlar üzerindeki kısa vadeli etkilerine odaklanarak, bilinen tüm biyofiziksel etkileri ve elektromanyetik alanların neden olduğu diğer etkileri kapsar. 2013/35/EU sayılı Direktif, işçi bilgisi ve eğitimi, resmi maruziyet ve risk değerlendirmelerinin sürdürülmesi, sağlık gözetimi ve daha fazlası için gereklilikleri detaylandırmaktadır.
Yönerge 0 Hz – 300 GHz frekans aralığını kapsar ve tüm mesleki sektörler için geçerlidir; maruz kalma sınır değerleri ve eylem seviyeleri sırasıyla ICNIRP 2010 ve ICNIRP 2009 ile aynıdır. Yönerge, iki genel EMF maruziyeti seviyesini kapsar: duyusal etkiler ve sağlık etkileri.
Birinci Seviye: Duyusal Etkiler 0 Hz – 10 MHz
Bu daha düşük maruz kalma seviyesinde, çalışanlar duyularıyla ilgili geçici sorunlar ve beyin işlevlerinde küçük dalgalanmalar yaşarlar. Yaygın bir yan etki, kişinin görüşünü bozan ışık parlamaları olan manyetofosfenlerdir. Direktifin güvenlik sınırları, çalışanların merkezi sinir sistemine müdahale eden elektromanyetik enerjinin yan ürünü olan bu yan etkileri asla yaşamamasını sağlayacak şekildedir. Yönerge, Duyusal Etkilere Maruz Kalma Seviyesi Değerleri (ELV'ler) adı verilen bu semptomlar için limitler tanımlar.
İkinci Seviye: Sağlık Etkileri 100 kHz – 300 GHz
İkinci, daha yüksek düzeyde maruz kalma, bölgedeki personelin vücuduna ve periferik sinir sistemine zarar vererek doğrudan sağlığını tehdit eder. Bu, sinir ve kas dokusunu uyaran termal ısıtma olarak kendini gösterir. Yönerge, Sağlık Etkileri ELV'leri olarak adlandırılan bu semptomlar için sınırlar belirler.
Çalışanların her iki radyasyon seviyesine de maruz kalmalarını önlemek için standart, uyulması gereken eylem seviyeleri (AL'ler), her iki ELV'ye de uygun olan işyeri için ideal operasyonel seviyeler gerektirir. Alt AL'ler aşıldığında önleyici ve koruyucu önlemler alınmalıdır.
EMF Direktifi, işverenlerin işyerindeki elektromanyetik alanlardan kaynaklanan mesleki tehlikeleri değerlendirmesini ve gerekirse işçilerin maruz kaldığı radyasyon seviyesini belirlemesini zorunlu kılar. Aşağıdakiler, bir risk değerlendirmesi sırasında dikkate alınması gereken faktörlerin bir listesidir:
- Sağlık Etkisi ELV'leri, Duyusal Etki ELV'leri, AL'ler
- Çalışanın vücuduna ve işyerinin hacmine göre dağılım da dahil olmak üzere maruz kalma sıklığı, düzeyi, süresi ve türü
- Doğrudan biyofiziksel etkiler
Hamile çalışanlar, kalp pili gibi pasif veya aktif implante tıbbi cihazlar kullananlar ve insülin pompaları gibi vücutlarında tıbbi cihazlar kullananlar gibi özellikle risk altındaki çalışanların sağlık ve güvenliği üzerindeki etkiler.
İşverenlerin, özellikle aşağıdakilerle ilgili olarak, EMF'ye maruz kalmayı önlemek ve buna karşı koruma sağlamak için çalışanlarını gerekli bilgi ve eğitimle donatması gerekir:
- Direktifte belirtilen ve işyerinde uygulanan uygulamalar
- ELV'ler ve AL'ler kavramı ve bunların değerleri, ilişkili olası riskler ve önleyici tedbirler
- Maruz kalmanın dolaylı etkileri
- Maruziyet değerlendirmesinin sonuçları
- Maruz kalmanın olumsuz sağlık etkileri nasıl tanınır ve raporlanır
- Merkezi veya periferik sinir sistemindeki etkilerle ilgili geçici semptom ve duyumların olasılığı
- İşçilerin sağlık gözetimine hak kazandığı durumlar
- Maruz kalma risklerini en aza indiren güvenli çalışma uygulamaları
- Artan seviyelerde veya riskte çalışıyor (daha önce referans verilmiş - hamile, tıbbi cihaz takıyor vb.)
AB, işverenlerin aşağıdaki konularla ilgili olarak bağlayıcı olmayan pratik kılavuzları çalışanlarına sunmasını zorunlu kılmaktadır:
Aşağıdakiler dahil ilgili AB veya uluslararası standartları dikkate alarak maruziyetin belirlenmesi:
- ELV'lerin değerlendirilmesi için hesaplama yöntemleri
- Harici elektrik ve manyetik alanların uzamsal ortalaması
- Ölçümler ve hesaplama belirsizlikleri ile başa çıkmak için rehberlik
- Yerleşik dozimetriye dayalı olarak, belirli durumlarda tek tip olmayan özel maruziyet türlerinde uyumun gösterilmesine ilişkin rehberlik
- Düşük frekanslı alanlar için 'ağırlıklı tepe yöntemi'nin ve yüksek frekanslı alanlar için 'çok frekanslı alanlar toplamının' açıklaması
- Risk değerlendirmesinin yürütülmesi ve mümkün olan her yerde, özellikle KOBİ'lerin ihtiyaçları dikkate alınarak basitleştirilmiş tekniklerin sağlanması
- Maruz kalma düzeyine ve işyeri özelliklerine bağlı olarak belirli önleme önlemleri dahil olmak üzere risklerden kaçınmayı veya azaltmayı amaçlayan önlemler
- Madde 10(1)(a) kapsamına giren MRI ile ilgili faaliyetler sırasında elektromanyetik alanlara maruz kalan işçiler için belgelenmiş çalışma prosedürlerinin yanı sıra özel bilgi ve eğitim önlemlerinin oluşturulması
- Hem termal hem de termal olmayan etkilerin dikkate alınması gereken 100 kHz ila 10 MHz frekans aralığındaki maruziyetlerin değerlendirilmesi
- Madde 8(2) uyarınca işveren tarafından sağlanacak tıbbi muayeneler ve sağlık gözetimine ilişkin rehberlik
